Acceptance of terms and conditions

These terms and conditions (terms) apply to use of this website including online purchases of our Products. By accessing and using this site, you accept and agree to these terms.

These terms (and the provision of Products by us) are governed by and to be interpreted in accordance with New Zealand law.

We reserve the right to amend these terms at any time without notice.  Updated terms will take effect once published on our website www.safetycabinets.co.nz and will apply to any order for Products placed following the update. 

Interpretation

“Company” “we” “us” means The Safety Cabinet Warehouse.

“Customer” “you” means the party placing the order to purchase the goods. 

“Products” means the goods ordered from the Company.

Orders

A contract to purchase Products will exist upon acceptance by the Company of the Customer’s order. An order may be made by the Customer online and upon acceptance by the Company shall incorporate these terms and conditions.

Payment

All orders must be paid for in full at the time of placing the order. Your credit card details will not be stored in our database and will be deleted upon receipt of authorisation that payment has been received.

Return of Products

To the fullest extent permissible by law, the return of Products shall be at the company’s sole discretion.  For any Products accepted for return, the Company’s liability is limited to either (at the Company’s discretion) replacing the defective goods or providing a refund of the Purchase Price. 

Cancellation Policy 

Cancellation of your order within 2 working days of confirmation of your order and prior to dispatch of the Product will allow you to apply for a full refund. The full refund can be applied to the credit card used to purchase the product, or the bank account used to pay for the product by internet banking. Cancellation refunds will not be paid after 2 working days of confirmation of your order or if the product has been dispatched. 

Purchase of Electrical or Electronic Parts 

You acknowledge that the Company shall not be held liable for any issues resulting from any installation or for the noncompliance of any electrical or electronic product or its replacement or repair should it prove to be faulty.

Delivery

Delivery of products will be via a third party transport company.  The Company will not be responsible for any delays in the delivery of the Products which are outside the Company’s control.  The Company will use all reasonable endeavours to enable the Products to be dispatched from the Auckland warehouse within 1-3 working days after payment. If a product ordered is not in stock at the time of order and payment, the Company will use all reasonable endeavours to contact you within 1-3 working days to negotiate a new dispatch date. Risk in products shall pass to the customer on delivery.

Specifications

All specifications and information relating to the Products is provided by the manufacturers and suppliers. The Company gives no representation or warranty whatsoever as to the condition or the quality of the Products or their suitability or fitness for purpose and no other warranties either express or implied by law are made with respect to these products.  To the extent permissible by law any implied and statutory warranty on the part of the Company is excluded. 

 

Liability

The Company’s liability for any loss, damage or injury arising directly or indirectly from any defect or non-compliance in the Products, or any other breach of the Company’s obligations, shall be limited to the manufacturer’s warranty on the Products. 

The Company shall be under no liability to the Customer (whether in contract, tort or otherwise) for any loss (including but not limited to, loss of any profits and consequential loss) of any kind whatsoever arising out of the supply or failure to supply Products. 

 

The Customer acknowledges that Products are supplied for business purposes and the provisions of the Consumer Guarantees Act 1993 shall not apply.

In the event the Products are supplied “in trade” (within the meaning of the Fair Trading Act 1986), the parties contract out of section 9, 12A and 13 of that Act and agree that it is fair and reasonable for them to do so. 

To the extent permitted by the Contract and Commercial Law Act 2017, all implied terms and conditions are excluded.

Force Majeure 

Notwithstanding any other provision of these terms and conditions, non-performance by the Company of any of its obligations under these terms and conditions will be excused, without liability for non-performance, during the time and to the extent that performance is prevented, wholly or substantially, by any event or circumstance (whether arising from natural causes, human agency or otherwise) that is beyond the reasonable control of the Company, including strikes, lockouts or other labour disputes, riot, civil commotion, pandemic, fire, flood, drought, loss or delay at sea, breakdown or war (whether declared or not) (Force Majeure Event).  Performance of any obligation affected by a Force Majeure Event will be resumed as soon as reasonably possible after the termination or abatement of the Force Majeure Event.

General

If any part or provision of these terms is deemed to be invalid, unenforceable or illegal, the remaining provisions shall remain in full force and effect.

The Company has this privacy policy because it understands that it is important for you to know how the Company collects, stores, and uses your personal information. By using this website, you acknowledge that your personal information will be treated as described in this policy.

The Company does this in a variety of ways, including when you: Purchase products or services from us; Access and use our website and communications; Call, email or interact with our staff; Complete an application for a product or service. 

If we are not able to collect personal information 

If you choose not to provide us with the personal information described within this policy, then we may not be able to provide you with the product or services you have requested, either to the same standard or at all.

The primary purpose for which we collect information about you is to enable us to perform our business activities and to provide the best possible customer service. We collect, hold, use, and disclose your personal information for the following purposes: to provide products and services to you; to manage product or service warranties or guarantees, including product or safety recalls; to communicate with you and process your requests; to verify your identity; to investigate if we have reason to suspect a breach of any of our terms and conditions or any suspected unlawful activity. Your personal information will not be shared, sold, rented, or disclosed other than as described within this policy or as permitted by the Privacy Act.

The Company will take all reasonable steps to protect the personal information that it holds from misuse, loss, or unauthorised access or modification. If you suspect any misuse or loss of, or unauthorised access to, your personal information, please let the Company know immediately.
